Can I Refuse Field Sobriety Tests?

If you are pulled over on suspicion of drinking and driving, a police officer will likely ask you to perform either the horizontal gaze nystagmus, the walk and turn test, or the one leg stand test. While most people agree to take these field exams, Georgia law gives drivers the right to abstain from taking them. You are fully protected by law from being forced to give evidence against yourself. The right is yours to exercise. It may be to your benefit to politely decline to take a test since these tests are subjective and an officer's belief that you are intoxicated may influence their grading of your performance.
