Georgia’s Underage DUI Laws
Georgia has a “no tolerance” law for underage drivers. A driver under 21 years old can be charged with a DUI in Georgia for operating a vehicle with a blood alcohol content (BAC) level of at least .02 percent, rather than .08 percent for drivers who are 21 and older.
There are two types of underage DUIs in the state: DUI “per se” and DUI "less-safe". The former occurs when an underage driver takes a breath or blood test and receives a result of at least .02 percent, while the latter occurs when an underage driver refuses to take a chemical test or is impaired by drugs.
