After getting convicted of a DUI in Georgia, the judge will decide the penalties you must serve according to the state’s laws. These laws determine the penalty ranges according to the number of previous DUI convictions you have that occurred within the last five years for enhancements to driver’s license suspension and ten years for enhancements in your punishment.

Possible Penalties for a First Offense DUI in Georgia:

  • Jail sentence between 10 days and one year
  • A fine between $300 and $1,000 (not including court costs and other fees)
  • Driver’s license suspension for up to one year
  • Minimum 40 hours of community service
  • DUI School attendance
  • Substance abuse counseling

2nd DUI Offense in Georgia Possible Penalties:

  • Jail sentence between 90 days and one year
  • A fine between $600 and $1,000 (not including court costs and other fees)
  • Driver’s license suspension for up to three years
  • Ignition interlock device (IID) installation for up to 120 days after suspension
  • 30 days (240 hours) of community service
  • DUI School attendance
  • Mandatory substance abuse counseling

A third DUI Offense is punishable by the following:

  • Jail sentence between 120 days and one year
  • A fine between $1,000 and $5,000 (not including court costs and other fees)
  • Driver's license suspension for up to five years
  • Surrender of license plate
  • 30 days (240 hours) of community service
  • DUI School attendance
  • Mandatory drug and alcohol treatment

  • Habitual Violator Status

A fourth DUI conviction (felony) is punishable by the following:

  • Prison sentence between one year and five years
  • A fine between $1,000 and $5,000
  • Driver’s license suspension for up 10 years
  • Surrender of license plate
  • 60 days (480 hours) of community service
  • DUI School attendance
  • Mandatory drug and alcohol treatment
  • Convicted Felon Status
