What Can My DUI Be Reduced To?

The most common charge reduction for DUI is reckless driving. This is a much less serious misdemeanor charge that will typically only result in a fine. With a reckless driving charge, the driver may also avoid other potential penalties of a DUI like ignition interlock device use, license suspension, and more.

Factors That Influence a Potential Charge Reduction

Some cases will be much more likely to receive a reduced charge than others.

  • If it’s your first DUI: First-time offenders will usually be granted more leniency from the courts. This is because they have no record of repeated offenses, and there is still reason to believe that their DUI is a one-time mistake they won’t make again.
  • Reasonable BAC: If the driver’s BAC was under or around the legal limit of .08%, it’s reasonable to believe that the driver was unaware they were breaking the law and driving under the influence. However, someone’s BAC being significantly higher than .08% can result in the opposite of a charge reduction – enhanced penalties.
  • No accident occurred: If it was a standard DUI stop that did not involve a crash causing property damage or injury, there is a higher chance that the DUI charge can be reduced.
  • Your attorney: Working with an attorney gives you the best chance of a charge reduction. Trying to handle your DUI case on your own is difficult and will likely not result in the best possible outcome.
